Dris Terms and Conditions

These Terms and Conditions ("Terms") are a binding agreement between you and Dris Corporation ("Dris," "we," "us," or "our"), a licensed Massachusetts cannabis retailer and delivery operator, Massachusetts Cannabis Control Commission License No. MD1321.

These are the only terms that apply to Dris. They govern your use of:

  • our marketing websites, drisbrands.com and getdris.com;
  • our online menu, storefront, and checkout, including cannabisdeliveryma.com, which are operated for us by our technology provider, Sweed; and
  • the Dris mobile application, including the Dris Early Access app.

Together these are the "Services." When you place an order through our online menu, your contract is with Dris Corporation, not with Sweed or any other technology provider. Sweed operates that storefront on our behalf. Where a page on our menu links to terms of service, it links here, and these Terms replace any earlier terms shown there.

By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

Our Privacy Policy, set out above, explains how we handle your personal information and is incorporated into these Terms by reference.

1. Eligibility

You may use the Services only if you are 21 years of age or older. Cannabis delivery is available only to qualifying addresses in Massachusetts.

You must complete age and identity verification before placing an order, as required by Massachusetts law. You agree that all information you provide during verification is truthful and relates to you. Providing false information, or using another person’s identification, is grounds for immediate termination of your account and may be a criminal offense.

You may not order on behalf of, or resell or transfer cannabis products to, any person under 21.

2. Your Account

You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it. Notify us at support@drisbrands.com immediately if you believe your account has been used without your authorization.

You may not create more than one account, create an account using another person’s information, or transfer your account to anyone else.

We may suspend or terminate your account at any time if we believe you have violated these Terms, applicable law, or the conditions of our license.

3. Products, Pricing, and Availability

Product listings, descriptions, images, and prices on the Services are provided for convenience and may contain errors or become out of date. Product availability changes constantly and inventory shown on the Services may not reflect what is physically in stock.

We reserve the right to correct errors, change prices, limit quantities, and refuse or cancel any order — including after an order has been placed — at our discretion or where required by law or by purchase-limit rules set by the Massachusetts Cannabis Control Commission.

All applicable state and local cannabis taxes are added at checkout.

4. Orders and Delivery

Placing an order is an offer to purchase. Your order is accepted only when we confirm it. Acceptance is always conditional on successful age and identity verification.

Delivery estimates are estimates, not guarantees. Delivery windows may be affected by traffic, weather, staffing, inventory, and regulatory requirements.

At delivery, you must be physically present at the delivery address; present the same valid, unexpired government-issued ID used to verify your account; and be sober and not visibly impaired.

Our drivers are required by law and by our policies to refuse delivery if any of these conditions is not met. A refused delivery may be subject to a restocking or trip fee, which will be disclosed before you order.

Cannabis products are generally not returnable or refundable once delivered, except where a product is defective or where a return is permitted or required by Massachusetts law. Contact support@drisbrands.com about any product concern — all order, refund, and delivery questions are handled by Dris, whatever platform you ordered on.

5. Rewards, Points, and Referrals

The App may offer points, ranks, quests, leaderboards, and referral codes.

Points are earned only through in-app actions. They are not tied to money spent, have no cash value, are not property, and are not redeemable for cash or for cannabis products. Nothing in the rewards program is an inducement to purchase cannabis, and no discount on cannabis products is provided in exchange for points.

If you invite people using the referral feature, you are responsible for the invitations you send. You may invite only people you personally know who are 21 or older, and only people you reasonably believe would welcome the invitation. You may not send bulk or unsolicited invitations, and you may not invite anyone who has asked you not to. Invitations are sent by your own device using your own messaging app.

We may modify, suspend, or discontinue the rewards program, or adjust point balances and ranks, at any time, including to correct errors or to address abuse of referral codes, invitations, or quests.

6. Content You Post

You may post product reviews and other content through the App. You retain ownership of your content. By posting, you grant Dris a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute that content in connection with the Services.

You agree not to post content that is false, misleading, or not based on your own experience; contains personal information about you or any other person; infringes anyone’s intellectual property or privacy rights; is unlawful, defamatory, harassing, hateful, or obscene; makes medical or therapeutic claims about cannabis products; or promotes cannabis to anyone under 21.

We may remove, hide, or refuse to publish any content at our discretion. A review reported by more than one member is hidden automatically until a member of our team reviews it. We do not endorse content posted by members, and views expressed in reviews are those of their authors.

7. Acceptable Use

You agree not to use the Services for any unlawful purpose or in violation of Massachusetts cannabis law; attempt to gain unauthorized access to the Services, our servers, or another user’s account; interfere with or disrupt the Services, including by introducing malware or by scraping, crawling, or automated data collection; reverse engineer, decompile, or attempt to derive the source code of the App; or reproduce, resell, or commercially exploit any part of the Services.

8. Intellectual Property

The Services, including all text, graphics, logos, product images, software, and the Dris name and marks, are owned by Dris or our licensors and are protected by intellectual property law. These Terms grant you a limited, revocable, non-exclusive, non-transferable license to use the Services for your own personal, non-commercial purposes. No other rights are granted.

9. Technology Providers and Third-Party Links

Parts of the Services are operated for us by technology providers — in particular, our online menu, storefront, and checkout are provided by Sweed. Those parts are still our Services: they are governed by these Terms and by our Privacy Policy, your contract is with Dris, and you do not enter into a separate agreement with the provider by using them.

Separately, the Services may link to genuinely third-party sites and services, including marketplace listings such as Weedmaps and Leafly, mapping providers, and payment processors. We do not control those and are not responsible for their content, practices, or terms. Your use of a third-party site is governed by that party’s own terms and privacy policy.

10. No Medical Advice; Health and Safety

Content on the Services is provided for general informational purposes only and is not medical advice. Cannabis products have not been analyzed or approved by the U.S. Food and Drug Administration. There may be health risks associated with the consumption of cannabis products, and their effects may be delayed. Cannabis should not be used by anyone who is pregnant or breastfeeding, and you should not drive or operate machinery under the influence of cannabis. Consult a physician before using cannabis products if you have questions about your health.

11. Disclaimer of Warranties

To the fullest extent permitted by law, the Services are provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, timely, secure, or error-free, or that any defect will be corrected. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Dris Corporation and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

12.1. Your use of, or inability to use, the Services.

12.2. Any unauthorized access to or use of our servers or any information stored on them.

12.3. Any errors or omissions in content on the Services.

12.4. Any interruption or cessation of transmission to or from the Services.

12.5. Any bugs, viruses, or similar harmful code transmitted to or through the Services by any third party.

12.6. Any content posted by third parties on the Services, or the defamatory, offensive, or unlawful conduct of any third party.

Cap on liability. To the fullest extent permitted by law, our total aggregate liability to you for all claims arising out of or relating to the Services or these Terms shall not exceed the greater of (a) the total amount you paid to Dris in the six months preceding the event giving rise to the claim, or (b) one hundred dollars ($100).

13. Indemnification

You agree to indemnify, defend, and hold harmless Dris Corporation and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising from:

13.1. Your use or misuse of the Services.

13.2. Your violation of these Terms or any applicable law or regulation.

13.3. Your violation of any third-party rights, including intellectual property or privacy rights.

13.4. Any content you submit, post, or transmit through the Services.

13.5. Your provision of false information during age or identity verification.

13.6. Invitations you send through the referral feature, including to anyone who did not wish to receive one.

14. Exceptions

Nothing in these Terms limits or excludes liability for death or personal injury resulting from negligence; fraud or fraudulent misrepresentation; or any other liability that cannot be excluded or limited under applicable law, including the Massachusetts Consumer Protection Act, M.G.L. c. 93A.

15. Governing Law and Venue

These Terms and any dispute arising out of or relating to them or the Services are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws rules.

You and Dris agree that any action or proceeding shall be brought exclusively in the state or federal courts located in Suffolk County, Massachusetts, and you consent to the personal jurisdiction of those courts.

Cannabis remains illegal under federal law. Nothing in these Terms is intended to require either party to violate federal law.

16. Informal Dispute Resolution

Before filing any claim, you agree to contact us at support@drisbrands.com and give us 30 days to resolve the issue informally. Most concerns can be resolved this way. This step is a condition of bringing a claim, except for claims that may be brought in small claims court.

17. Changes to These Terms

We may update these Terms from time to time. We will post any update on this page and revise the "Last Updated" date. Because our menu and storefront link here, an update to this page updates the terms for every part of our service at the same time. Material changes take effect 30 days after posting, and we will provide notice by email or through the App. Your continued use of the Services after a change takes effect means you accept the updated Terms.

18. General

Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.

No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.

Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.

Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and Dris regarding the Services, and replace all prior versions and any terms previously shown on our menu or storefront pages.

Survival. Sections 8, 11, 12, 13, 14, 15, and 18 survive termination of your account or of these Terms.
